By utilizing our custom Voice AI, conversational agents, database reactivation services, or any associated software (collectively, the "Services"), you ("Client," "you," or "your") acknowledge and agree to the following terms:

1. Artificial Intelligence and Accuracy Limitations
JASM'N AI utilizes advanced artificial intelligence and machine learning models to facilitate voice and text-based communications. While we optimize these systems for accuracy and highly professional, human-like interaction, AI is inherently probabilistic. We do not guarantee that the AI will be 100% error-free, completely factual, or act perfectly in every edge-case scenario. The Client accepts all risks associated with "AI hallucinations," misinterpretations of customer intent, or unintended responses generated by the AI employees. JASM'N AI is not liable for any lost business, reputational harm, or damages resulting from automated interactions.

2. No Guarantee of Financial Results

Any figures, closing rates, case studies or Return on Investment (ROI) projections presented in our marketing materials, funnels, websites or proposals are estimates based on historical data and optimized scenarios. Please note that the data and scenarios referenced may be sourced from, but are not limited to, independent research, third-party websites, client testimonials, aggregate industry data, other AI agencies, and predictive modeling. While these examples showcase the transformative power of AI automation, every business operates in a unique market with varying variables (e.g., offer quality, target demographic, lead history). JASM'N AI makes no representations, warranties, or guarantees regarding specific financial outcomes, exit valuations, conversion rates, or performance results. Your actual results will vary depending on your specific business model, market conditions, and operational execution.

3. Telecommunications and Regulatory Compliance (TCPA)

Our Services include automated SMS text-backs, aggressive database reactivation, and automated voice dialing. The Client assumes full and sole responsibility for ensuring that all contacts within their database have provided legally sufficient, explicit consent to receive automated marketing communications. JASM'N AI acts solely as a technology provider and is not responsible for the Client's compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, or any state-specific telemarketing laws. The Client agrees to indemnify and hold JASM'N AI harmless from any legal claims, fines, or damages resulting from unauthorized outreach.

4. Third-Party Platform Reliance

JASM'N AI integrates with various third-party platforms (including, but not limited to, Meta, Google Business Profiles, Twilio, and various CRM/scheduling software). We are not responsible for service interruptions, API changes, account suspensions, or data loss caused by these third-party providers.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall JASM'N AI, its founders, employees, or contractors be liable for any indirect, punitive, incidental, special, or consequential damages, including without limitation damages for lost profits, lost data, or business interruption, arising out of or in any way connected with the use or performance of the Services.
